These Terms and Conditions (“Terms”) govern your access to and use of the website operated by the New Mexico Chapter of the International Association of Arson Investigators (“NMIAAI,” “Chapter,” “we,” “us,” or “our”), including iaai-nm.org and any associated webpages, forms, event listings, registration services, payment features, and other online services collectively referred to as the “Website.”
By accessing or using the Website, submitting a form, registering for an event, applying for membership, or completing a transaction through the Website, you agree to these Terms. If you do not agree with these Terms, do not use the Website.
1. About NMIAAI
NMIAAI is the New Mexico Chapter of the International Association of Arson Investigators. The Chapter supports fire and explosion investigation professionals through training, education, professional development, certification support, networking, and collaboration among public- and private-sector professionals.
NMIAAI is an affiliated chapter of the International Association of Arson Investigators (“IAAI”). The Website may contain information about or links to IAAI programs, certifications, membership services, and websites. Unless expressly stated otherwise, services provided directly by IAAI are governed by IAAI’s own terms, policies, eligibility requirements, and procedures.
2. Permitted Use of the Website
You may use the Website only for lawful purposes and in accordance with these Terms.
You agree that you will not:
Use the Website in violation of any applicable federal, state, local, or international law;
Attempt to gain unauthorized access to the Website, its servers, administrative areas, accounts, databases, or connected systems;
Introduce viruses, malicious code, automated attacks, scraping tools, or other technology intended to disrupt or damage the Website;
Interfere with the operation, security, or availability of the Website;
Impersonate NMIAAI, IAAI, a Chapter officer, member, instructor, agency, organization, or another person;
Submit false, misleading, fraudulent, defamatory, threatening, discriminatory, or unlawful information;
Use information from the Website to send unsolicited commercial communications;
Copy, reproduce, sell, republish, distribute, or commercially exploit Website content without authorization; or
Use the Website or its content in a manner that could damage the reputation, operations, or legitimate interests of NMIAAI or IAAI.
We may restrict or terminate access to the Website when we reasonably believe a user has violated these Terms or engaged in conduct that threatens the Website, the Chapter, its members, or others.
3. Professional and Educational Information
Information provided through the Website is intended for general informational, educational, and professional-development purposes.
Website content does not constitute:
Legal advice;
Engineering advice;
Scientific or laboratory analysis;
An official fire-origin-and-cause determination;
Investigative consultation concerning a particular incident;
Expert-witness advice or testimony;
Agency policy or operational direction;
Certification of an individual’s competence;
A guarantee of continuing-education credit;
An emergency service; or
A substitute for applicable laws, regulations, professional standards, adopted codes, agency procedures, or qualified professional judgment.
Fire and explosion investigations are fact-specific. Users are responsible for independently verifying information and applying appropriate laws, standards, methodologies, safety procedures, and professional judgment.
Unless specifically stated, views expressed by instructors, presenters, contributors, members, or linked organizations are their own and do not necessarily represent the official position of NMIAAI, IAAI, any government agency, employer, or affiliated organization.
4. No Emergency or Case-Submission Service
The Website is not an emergency reporting system, investigative hotline, evidence-submission portal, or request-for-service system.
Do not use the Website to report an active fire, crime, emergency, hazardous condition, or immediate threat. Contact 911 or the appropriate public-safety agency.
Do not submit evidence, investigative files, criminal-justice information, protected personal information, medical information, privileged communications, confidential case information, controlled unclassified information, or other sensitive material through a general Website form unless NMIAAI has expressly authorized a secure method for that purpose.
Submission of information through the Website does not create an attorney-client, expert-client, consultant-client, fiduciary, investigative, or confidential relationship.
5. Membership
Membership applications and membership status are governed by the NMIAAI bylaws, membership requirements, ethical standards, and policies in effect at the relevant time.
Submission of an application or payment of dues does not guarantee approval. Membership may require review and approval as provided by the Chapter’s governing documents.
Applicants and members are responsible for providing accurate, complete, and current information. NMIAAI may deny, suspend, or terminate membership as permitted by its bylaws and policies, including for nonpayment of dues, misrepresentation, unethical conduct, conduct harmful to the Chapter or profession, or failure to satisfy membership requirements.
Chapter membership obtained directly through NMIAAI does not automatically include membership in the International Association of Arson Investigators. Individuals seeking dual membership must follow the applicable IAAI enrollment process and select NMIAAI as their chapter affiliation.
When these Terms conflict with the NMIAAI bylaws regarding membership eligibility, voting rights, discipline, governance, or internal Chapter affairs, the bylaws control.
6. Training, Conferences, and Events
Event descriptions, locations, instructors, schedules, course topics, availability, continuing-education hours, certification eligibility, and other details may change.
NMIAAI may, when reasonably necessary:
Change an instructor, presenter, topic, schedule, venue, or delivery format;
Combine or cancel sessions;
Limit attendance;
Refuse or revoke registration for safety, misconduct, nonpayment, or eligibility reasons;
Reschedule or cancel an event because of insufficient enrollment, weather, emergencies, instructor availability, venue issues, government restrictions, or circumstances beyond the Chapter’s reasonable control; or
Establish additional event-specific rules.
Attendance does not guarantee certification, credentialing, continuing-education acceptance, employment advancement, professional qualification, or successful completion of an examination or practicum.
Participants are responsible for confirming whether training hours will be accepted by their employer, licensing body, certification organization, court, agency, or other authority.
Certain training activities may involve fire scenes, damaged structures, vehicles, tools, demonstrations, practical exercises, potentially hazardous environments, or physically demanding activities. Participants must follow all safety instructions, venue requirements, personal protective equipment requirements, and instructor directions.
NMIAAI may require participants to execute separate acknowledgments, safety agreements, liability waivers, media releases, or other event-specific documents. These Terms do not replace any separate event agreement.
7. Fees, Payments, Cancellations, and Refunds
Membership dues, event fees, sponsorship fees, merchandise purchases, and other transactions may be processed through the Website or through a third-party service provider.
You agree to provide accurate billing and payment information and authorize the applicable amount to be charged using the payment method you select.
Prices, deadlines, cancellation rights, refund eligibility, transfer rights, substitution rules, and other transaction terms may be stated on the applicable membership, event, registration, invoice, or checkout page. Those transaction-specific terms are incorporated into these Terms.
When transaction-specific terms conflict with these general Terms, the transaction-specific terms control for that purchase or registration.
Unless expressly stated otherwise:
Payment does not guarantee membership approval, event admission, certification, or course completion;
Processing fees and third-party transaction fees may be nonrefundable;
Refunds, credits, transfers, and substitutions are not guaranteed;
NMIAAI may correct pricing, description, registration, or processing errors; and
NMIAAI may cancel or refund a transaction that was accepted because of an obvious error, lack of availability, eligibility issue, or event cancellation.
NMIAAI will process authorized refunds using the original payment method when reasonably possible. Banks and payment processors may require additional time to post a refund.
NMIAAI is not responsible for personal travel costs, lodging, meals, lost wages, agency expenses, or other incidental costs resulting from an event change or cancellation unless the Chapter expressly agrees otherwise in writing.
8. Sponsorships, Vendors, and Advertisers
References to sponsors, vendors, exhibitors, service providers, products, or commercial organizations do not necessarily constitute an endorsement, certification, warranty, or recommendation by NMIAAI.
Sponsorship and vendor participation may be subject to separate written agreements, event rules, payment terms, space limitations, and approval by the Chapter.
Sponsors and vendors are solely responsible for their products, services, representations, warranties, transactions, and legal compliance.
9. Contact Forms and Other Submissions
When you submit information through the Website, you represent that:
The information is accurate and lawful;
You have the authority to provide it;
It does not violate another person’s rights;
It does not contain malicious software or harmful code; and
Its submission does not violate any legal, employment, contractual, confidentiality, or agency obligation.
You grant NMIAAI permission to use, reproduce, store, and share the submitted information as reasonably necessary to respond to your request, administer membership, conduct Chapter business, process a registration, address a concern, or comply with law.
Do not submit unsolicited proprietary proposals, confidential business concepts, investigative strategies, or other information for which you expect compensation, confidentiality, or ownership protection.
NMIAAI is not obligated to respond to every submission.
10. Photographs, Video, and Event Media
NMIAAI may photograph, record, or document Chapter meetings, conferences, training activities, awards, presentations, and public events.
Event-specific notices, registration terms, consent forms, or media releases will control the Chapter’s use of identifiable photographs, video, audio, or likenesses when such documents are provided.
Individuals with concerns regarding event photography or the use of a particular image should contact NMIAAI. The Chapter will review reasonable requests but cannot guarantee removal of material that has already been lawfully distributed, archived, published by others, or incorporated into completed materials.
Website users may not copy, download, alter, republish, commercially exploit, or misrepresent photographs or recordings from the Website without permission from NMIAAI and, when applicable, the photographer or rights holder.
11. Intellectual Property
The Website and its original content—including text, graphics, page designs, photographs, logos, compilations, downloadable materials, and other content—are owned by or licensed to NMIAAI and are protected by applicable intellectual-property laws.
IAAI names, logos, certification marks, and related branding may belong to the International Association of Arson Investigators and are used subject to applicable authorization and brand requirements. Other trademarks belong to their respective owners.
You may view and print Website material for personal, governmental, educational, or internal professional reference, provided that you:
Do not alter the material;
Do not remove copyright, trademark, attribution, or ownership notices;
Do not imply endorsement by NMIAAI or IAAI;
Do not use the material commercially; and
Do not distribute substantial portions without written authorization.
No rights are granted except those expressly stated in these Terms.
12. Copyright Concerns
A person who believes material appearing on the Website infringes a copyright should contact NMIAAI and provide:
Identification of the copyrighted work;
Identification and location of the allegedly infringing material;
The reporting person’s name and contact information;
A statement explaining the basis of the claim;
A statement that the information provided is accurate; and
Documentation showing the person is authorized to act for the copyright owner.
NMIAAI may remove or restrict access to disputed material while reviewing a good-faith claim.
13. Third-Party Websites and Services
The Website may link to services operated by IAAI, CFITrainer.Net, social-media platforms, mapping services, calendar providers, payment processors, hotels, event venues, sponsors, instructors, vendors, or other third parties.
NMIAAI does not control and is not responsible for third-party:
Content;
Availability;
Security;
Accessibility;
Privacy practices;
Terms and conditions;
Products or services;
Transactions; or
Representations.
Your use of a third-party website or service is governed by that provider’s own terms and policies. Links are provided for convenience and do not necessarily constitute endorsement.
14. Privacy and Electronic Communications
Information collected through the Website may be used to respond to inquiries, administer membership, process registrations and payments, communicate Chapter information, operate events, maintain records, improve the Website, and comply with legal obligations.
Use of personal information is also subject to any Privacy Policy posted on the Website. The Privacy Policy is incorporated into these Terms by reference.
By providing an email address or telephone number, you authorize NMIAAI to send communications reasonably related to your inquiry, membership, registration, payment, event participation, or Chapter business.
Marketing or promotional communications will be sent subject to applicable law and available opt-out rights. You may unsubscribe from nonessential email communications using the instructions provided in the message.
Electronic communications are not guaranteed to be secure, confidential, error-free, or continuously available.
15. Website Availability and Security
NMIAAI works to maintain the Website but does not guarantee that it will always be available, secure, uninterrupted, current, complete, or error-free.
The Website may be suspended or modified for maintenance, security, technical problems, platform changes, or other operational reasons.
You are responsible for maintaining appropriate cybersecurity protections, verifying downloaded material, and protecting your devices and information.
NMIAAI is not responsible for damage caused by malicious software, unauthorized access, third-party attacks, communication failures, internet outages, hosting-provider issues, or circumstances outside its reasonable control.
16. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ALL CONTENT, INFORMATION, SERVICES, LINKS, AND MATERIALS PROVIDED THROUGH IT ARE OFFERED “AS IS” AND “AS AVAILABLE.”
NMIAAI DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, AVAILABILITY, SECURITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, PROFESSIONAL COMPETENCE, AND RESULTS.
NMIAAI DOES NOT WARRANT THAT WEBSITE CONTENT WILL SATISFY ANY LEGAL, INVESTIGATIVE, CERTIFICATION, LICENSING, EMPLOYMENT, EVIDENTIARY, OR PROFESSIONAL REQUIREMENT.
Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
17. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NMIAAI AND ITS OFFICERS, DIRECTORS, MEMBERS, VOLUNTEERS, EMPLOYEES, INSTRUCTORS, PRESENTERS, CONTRACTORS, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO:
Use of or inability to use the Website;
Reliance on Website content;
Attendance at or inability to attend an event;
Event changes or cancellations;
Third-party websites or services;
Unauthorized access, data loss, or security incidents;
Membership decisions;
Lost profits, lost wages, lost data, lost opportunities, travel expenses, or business interruption; or
Conduct of another Website user, attendee, vendor, sponsor, or third party.
To the extent NMIAAI is found liable for a claim relating to a paid Website transaction, NMIAAI’s aggregate liability will not exceed the amount you paid directly to NMIAAI for the specific transaction giving rise to the claim during the twelve months preceding the event giving rise to liability.
This limitation does not apply where liability cannot legally be limited.
18. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless NMIAAI and its officers, directors, members, volunteers, employees, instructors, presenters, contractors, and agents from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys’ fees arising from:
Your violation of these Terms;
Your unlawful or improper use of the Website;
Information or material you submit;
Your violation of another person’s rights;
Your misconduct at a Chapter event; or
Your violation of an event, venue, safety, or registration requirement.
This provision does not require indemnification for conduct to the extent caused by the indemnified party’s gross negligence, willful misconduct, or other conduct for which indemnification is prohibited by law.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles.
Any legal action arising from these Terms or the Website must be brought in a state or federal court of competent jurisdiction located in New Mexico, unless applicable law requires another forum.
Before filing a legal action, the parties are encouraged to make a good-faith effort to resolve the dispute through direct written communication.
20. Changes to the Website or These Terms
NMIAAI may update the Website, its services, and these Terms as operational, legal, or organizational needs change.
Updated Terms will be posted on the Website with a revised “Last Updated” date. Changes become effective when posted unless a later date is stated.
Your continued use of the Website after updated Terms become effective constitutes acceptance of those changes.
21. Severability
If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted or severed, and the remaining provisions will remain in effect.
22. No Waiver
Failure by NMIAAI to enforce any provision of these Terms does not waive the Chapter’s right to enforce that provision or any other provision later.
23. Entire Agreement and Order of Control
These Terms, the Website Privacy Policy, applicable event or transaction terms, membership documents, and any separately executed agreement constitute the agreement governing your use of the Website.
For internal Chapter governance and membership matters, the NMIAAI bylaws and formally adopted Chapter policies control.
For a specific event, purchase, sponsorship, or registration, the applicable event-specific or transaction-specific agreement controls over conflicting provisions in these general Terms.
